Just sounded like you think people need to think about the legal side, but then say it's not a right..
Personally I only care about the legal side. Because it's a right for hetero couples to get married, our laws of equality says the same should happen for all people.

it's not a legal right however it is a legal contract and you have to go through a state usually at a court house to get a permit or lic.
does that help? i mean really if i'm off base i'll just not worry about it

ok .. i don't have time to read everything because i'm getting busy at home however i did skim over Jaerik's last statment and i don't agree with it because the 14th covers race and so the loving vs virginia would have been ruled on correctly we aren't talking about race here and frankly i don't care if your a homosexual or not if you want to be with someone be with them.

The beautiful thing about a constitutional rebublic is when its constitution doesn't address a specific issue, it's left up to the states. The natural right of freedom of movement allows you to move to another state that is more closely aligned with your beliefs. This is why when Federal powers extend past the imposed constutional limits, we lose our liberties as a whole.

California Proposition 8 (ban on gay marriage) has been struck down in federal district court as a violation of the US Constitution's Equal Protection clause.
This is the first time a state ban on gay marriage has been challenged in federal court. It is worth noting that the judge is a Republican and was appointed by Reagan.
It will now go to the 9th Circuit Court of Appeals, which is also in San Francisco. If the circuit court rules for gay marriage, it will also become legal in Alaska, Arizona, Hawaii, Idaho, Montana, Nevada, Oregon, Washington, Guam, and the Mariana Islands.
Regardless of the 9th Circuit's ruling, it will be appealed to the US Supreme Court (SCOTUS). If the 9th Circuit rules for gay marriage, SCOTUS must hear the case because of the fracture along state lines.
If the 9th circuit upholds the ban on gay marriage, SCOTUS can simply refuse to hear the case, effectively upholding the ban. Or they can agree to hear the case and make their own ruling, which will then apply to every state in the union.
