That's a very good question, SE in the U.S. could possibly say that windower is a rogue website. I'm not entirely sure though.

Then there is no excuse for anyone on this site, lurker or otherwise, to not take a serious look at this and be concerned.

well i don't live in the U.S. but waiting 2 years for a ***translated movie sucks.....not my fault that i wasn't born in your country. I can understand english so should i be punished for being born in another country?
Anyway if the income decreased and the price for everything raises then people can't afford cinema or any other legit source to watch the movie/to get the music, that's the point when piracy begins :x
stop fixing symptoms and start to fix the issue at the root.

Dunno if this has been posted yet but I think its HELP I AM TRAPPED IN 2006 PLEASE SEND A TIME MACHINE. Not SOPA but copyright related.

Piracy student loses US extradition fight.

Quote:

A judge ruled on Friday that a 23-year-old student can be extradited to the United States for running a website posting links to pirated TV shows and films, despite significant doubts over whether such sites break any UK laws.

The ruling threw Britain's contentious extradition treaty with the US, which critics allege is greatly biased against UK nationals fighting their removal to America, under further scrutiny. It came just hours after a businessman from Kent lost an appeal against the decision that he should be sent for trial in Texas for allegedly plotting to send missile components to Iran.

Richard O'Dwyer, a computing student at Sheffield Hallam University, faces a potential 10-year term in a US jail despite never having been to America or using web servers based in the country. When still a teenager O'Dwyer set up a website, TVShack, which posted links to pirated material. It did not directly host any files, which meant, according to the student's lawyers, that it acted as little more than a Google-type search engine and did not breach copyright.

The defence team pointed out that the only UK prosecution of a similar site, TV-Links, ended last year with the case being thrown out.

But the district judge, Quentin Purdy, ruled that O'Dwyer should nonetheless face trial in the US. "There are said to be direct consequences of criminal activity by Richard O'Dwyer in the USA, albeit by him never leaving the north of England," Purdy said. "Such a state of affairs does not demand a trial here if the competent UK authorities decline to act, and does, in my judgment, permit one in the USA."

O'Dwyer said he planned to appeal. His mother, Julia, broke down in tears outside the courtroom, saying the extradition treaty was fundamentally unfair. Describing herself as "disgusted" by the verdict, she said: "Look at how many people we send over there, and how few come here. If they can come for Richard, they can come for anyone."

She added: "David Cameron and Nick Clegg came into office saying they would fix this law," she said. "They need to pull their fingers out."

While O'Dwyer's defence portrayed him as the vulnerable, introspective young man whose promising career would be derailed by extradition, prosecutors contend he is a skilled businessman who made large sums of money from a website he knew was profiting from pirated material.

At its peak, TVShack was among the 1,800 most visited websites in the world, the court heard, bringing O'Dwyer advertising revenue of £15,000 per month. When US customs agents seized the site in 2010 it was replaced immediately with a slightly different domain name – and the addition on the front page of a rap video called *** Tha Police. O'Dwyer, who was bailed, said outside court: "I am obviously disappointed with the judge's decision today. I think I have got faith in the high court for making the right decision."

He said the website had "helped me no end with my studies" and said when he first set it up he "didn't even think it would get that popular, to be honest".

The second case concerns Christopher Tappin, a 64-year-old golf club president from Orpington. He admits arranging the shipment of batteries that can be used in Hawk air defence missiles, but insists he had no idea about their eventual destination.

His extradition was ordered last February, even though Tappin's lawyers claim he was the victim of a sting by US agents, who told him they would arrange the necessary export licenses.

Tappin, who said he made around £300 from the deal, appealed against the decision. Two high court judges dismissed this on Friday. "Entrapment, as far as I can see, is simply unsustainable on the facts as alleged in the request," their ruling said.

The best known case thrown up by the extradition treaty concerns Gary McKinnon, the computer hacker who has spent years fighting his removal to the US.

Opponents of the current arrangements, including many MPs, say the fact US prosecutors do not need to present prima facie evidence to gain extradition makes it too easy for British nationals to be sent over, where they often spend long periods in jail before trial.

The US Immigration and Customs Enforcement (ICE) agency has faced criticism for perceived overreach in targeting websites, like TVShack, with no direct US link.

In July the agency's assistant deputy director told the Guardian that ICE would now actively pursue websites similar to TVShack even if their only connection to the US was a website address ending in .com or .net.

Such suffixes are routed through Verisign, an internet infrastructure company based in Virginia, which the agency believes is sufficient to seek a US prosecution.

As a long time lurker I feel the need to say that I indeed filled out the google form and sent it in from the website, and even encouraged my boss and coworker to do so as well (though they are both twice my age and have no idea what SOPA even really is).

This is something not to be shrugged off.

As others have pointed out, this will redirect the path of the internet as a whole. I feel mildly ashamed as a Texan that the main supporter of this bill is a Texas representative, and he has and will continue to receive emails from myself.

It takes something of importance to get smaller voices out. I encourage all the little people, the lurkers, everyone who believes in freedom of speech to protest SOPA and the similar bills.

There needs to be civil unrest towards this bill before it can ever be put into action, not just after.

From that link:

"Smith predicted the bill would pass the House. It was about halfway through the process of committee hearings and could go to the House floor in a matter a weeks, he said. The Senate was considering a similar measure."

That is pretty scary.

Also the guy who started it is claiming that Google is against the bill because they make money directing people to these foreign sites. Give me a break.

People are saying that it could ban "Let's Plays" and satirical shows like Angry Video Game Nerd and Angry Joe. Because they use footage from copyrighted material.

Even though satirical content is protected under the fair use law, apparently this bill is so sweeping it would give the government power to shut them down if they wanted to.

I'm really confident that this bill will die before it takes effect (the backlash from the public would be unrelenting and unprecedented) but I do think a show of action would be great from this site to show solidarity with the larger sites opposed to this bill.

Take 'er down for a couple of hours.

Oh <.< Had me scared.. I don't think blacking out this site would really do anything.. I mean this isn't a generalized site, it's pretty content-specific, probably doesn't draw anywhere near the traffic that Reddit does.

Maybe if it was highly publicized, like no matter where you went on the page a huge pop up explaining the upcoming blackout.. I was here for quite a long *** time before I even posted, I just used the site as it was originally intended, to monitor the AH... Was a lot quicker and easier to just check my mule here, then actually login to it and check. Was a lot quicker to also check prices.

I didn't even look at the forum section for awhile, there are probably a lot of people who would view the blackout as nothing more than the site being down.. Even just a bar up top doesn't really help.. When BF3 goes down for maintenance, the forums blow up (literally) with sooooo many people trying to figure out why the game isn't work.. Nevermind that no matter what page they click on in battlelog there's a notice up top when it's down.

Well, if AH was going to blackout with a notice ahead of prior to the blackout time/date, it'd let people who might not know about it, (Yes, some people who play vidya games don't keep up with everything bout the interwebs) know what's going on/how they help stop it. Which is the point, trying to get the bill defeated. :<

Honestly did not think this would go over 2 pages, but I'm happy it did. I really am sick of politicians putting out bills like this it's such a slap in the face =/

I'm trying to keep telling everyone I know about it and I'm giving out the list of politicians who are voting for it because they are the type of people that need to be voted out of the system.

I would guess that only the large content owners with the resources will decide which sites gets the shaft. They will demand compensation for damages "or else". Who is going to make sure these companies aren't abusing their power? Will it be congress? (clueless morons). Some appointed team of easily bought government officials?

All these problems are created to try to stop piracy. /smh

I have considered in doing something for FFXIAH in the spirit of raising awareness of the issue.

Whenever these threads come up, I always think "Why are people so against soup?" ;_; "Sure, soup isn't a meal, and it isn't stew, but it's not that bad..." :p

But honestly (on-topic) I am all for the protection of intellectual property by the owners of that property, and all for their allowed defense to the rights to--and financial benefits derived from--their creations.

But I also feel that the extent of legal remedy for infringement of that right to IP should only go so far as previously-established means--tort/civil litigation for itemized/demonstrable damages or (in the case of outright criminal activity when the laws and jurisdiction are clearly established) criminal charges against the specific infringing parties.

If the injured party can honestly demonstrate a case for damages (or preponderance of guilt for a criminal charge) in a court of law that is determinable by a jury, then I think that is fair. If the injured party (claimant) feels it is "too much effort for too little return" to chase down particular offenders (defendants) in a given case or thousands of cases, then that is their choice...the same choice faced by any other injured party, whether an individual or institution, in a tort action. :/

Simply making it so that the injured party can bypass this traditional legal remedy out of convenience, especially at the potential cost of the liberties of others using those same services, is heavy-handed and gives way too much power to those who would certainly abuse it. To my mind it also removes the crux of determination of guilt or innocence out of the hands of the courts (and of the people.)

For certain American society is weary of its own litigious nature, but that nature exists for a reason. And while I am much more liberal in thought than libertarian, I do appreciate the value of that aspect of society--of both the threat of litigation as a deterrent to offenders, and the cost of litigation as a deterrent to claimants, in limiting how often frivolous tort cases occur.

EDIT: Oh yah...TLDR...forgot. :p

Quit being so @#@$ing lazy and just sue 'em (or don't) like you're supposed to, @#@$@es!

I wonder if they even plan to pass SOPA. I just feel like SOPA isn't going to pass, then they'll make a slightly "better" act. When they start to push this next act, they'll say that Google, Yahoo, Reddit, etc will never be satisfied and they'll pass the next one regardless.

Of course once the bar has been raised, a few years later we'll see another bill requiring more Internet rights be stripped from us. Until we're at the point that the Internet is hardly any different than TV or radio.

I remember when piracy was defined as profiting from misappropriated material. Nowadays it's merely the misappropriation of material.
I mean you can operate under the theory that downloading something prevents the online sale or physical-copy sale of said content but, in actuality, it is no different then going to someone else's house and watching it on their TV with them. They're both examples of free propagation of media.

As for that extradition, wrong, wrong, WRONG. I've never served an American student in a bar and refused them sale on the grounds that they were underage in their own home state. The law operates under the jurisdiction of the country you are in, not the one that feels like it's been wronged because it operates under a different theory altogether.
