Fromsoft don't need to do this. Mixed feelings on that; youtubers love to sensationalize things and deep down I expect this policy is not going to actually result in companies suing customers over criticism.

Reading this "policy", pretty much every point are illegal in many countries to begin with. So this policy adds nothing, it's more like an public announcement to me. Well, except the "Discriminatory speech and conduct regarding race, ethnicity, religion, family origin, occupation" part. I don't know if there are any country law that says discrimination is illegal. So even if someone discriminate against people you probably can't take legal actions I think? For everything else like violence, sexual harassment or defamation, any entity are entitled to take legal actions for breaking the law. It doesn't matter if your role is an individual, a mega corp or a customer. You break the law, you face legal actions. Being a customer shouldn't shield them from legal actions for committing crimes. There are definitely discrimination laws in any first world country (they dont apply if the victim is white, but thats another story)

If you're a rational, reasonable person, you may not realize just how intense the topic is. XIV players are extremely upset about the current state of their game, and Yoshida has gone out of his way to create a very unhealthy parasocial relationship with his players.
When they were happy this wasn't a problem. Now they are upset, a small minority of them think they can bother the team and him in any way they can find to do so and don't know when to stop. There was also a huge amount of drama over a voice actor they picked. I realized how intense this topic is, and how it negatively impacted the industry as a whole. The criticism goes to both sides who are responsible for starting this war. When SH2 was out I tried to search for reviews or discussion about the game, except 90% of the SH2 topics that I clicked on are people shitting on DEI and face model. If someone tried to say they like the game they are quickly being harassed and labeled as filthy "DEI supporters" that's responsible for the growth of DEI influence. Which effectively silenced actual positive relevant reviews. Those kind of irrelevant DEI discussion took away all our limited attention and traffic on legit game discussions. Now it takes longer to receive or search for legit game related discussion in the gaming community because of politics. It's already bad enough to get harassed for making a game that people dislike, it's worse to be harassed for having a political opinion in private space.
