It was ratified in 1992. These cartel are not in the US to live here or even to stay here permanently. If they were, that would be the definition of an immigrant.
Now with that wording cleared up. It is obvious, these cartel are trespassers, and should be dealt with accordingly. That is an act of war. Trump offered to "help" Mexico with the cartels, they declined the offer.

Sorry to necro this thread, but I found an article that detailed a possible solution to the problem with the cartels:
