They simply declined to prosecute based on what they currently have. So, it's try her now and risk getting her acquitted, and she gets off scott free while the prosecutor's reputation is destroyed and career ends in shambles, or they can bide their time, be patient, and hope she does something that will have a one hundred percent chance of nailing her on a conviction. Regardless of any of that, 15000 more emails were handed over to the FBI and I believe she claimed to have turned them all over under oath. Even a Jr. prosecutor could get her in jail for perjury. Another victim of the block feature. I already answered "statute of limitations" but he continues to profess legal knowledge without knowing anything about law. This "obviously has broken several laws" talk becomes much, much different when the jury goes into the deliberation room. Trust me on that one.
Was on jury duty once, assault charge for a guy who turns out was already in for life. We all knew without a shadow of a doubt he did it, we all vocally agreed on this. But we didn't have absolute, undeniable proof he did it because the camera on the bus where he assaulted the other inmate malfunctioned so all we saw was them get on the bus and for the rest of the ride, nothing. It doesn't matter what a jury thinks or believes. It's what they take from the proof given. If you go in with sketchy evidence and no absolute proof, it will end badly for you. Unless the Jury is biased, crooked, or being paid off...all I got was my gas money back. :(
