This is the staffer who set the e-mail server up. What is illegal in that? For that mater had the staffer plead the 5th?

Let's assume hillary isn't smart enough to set up an email server herself and she told someone else to do it.

but in order for a "conspiracy to commit ______" charge to stick you would need a witness that would testify that they saw her order the person that set it up to do so, or the person that set it up to say "hillary ordered me to set up the email server, I told her it was wrong and she told me to do it anyway" and then you also need the "one overt act" (which was setting up the server)
