Actually if you google religion and custody battle there is a recent trend for parents to have conflicts over religion in custody battles. The Indiania Law Journal wrote a well documented paper discussing the problem for judges around the country to include religion in custody cases or not. This includes all religions and those of no faith. Like I mentioned in another post most judges only discriminate on the basis of religion for fear of harm coming to the child and, in my opinion, thats the only time religion should ever enter into the discussion.
