not trying to derail the thread or anything but i saw this on the news yesterday and it was pretty disturbing.

how could a lawyer defend people like this...
***like that needs the death penalty and have it televised. but thats just my opinion.

Hmm, from deathpenalty.org:

"California taxpayers pay at least $117 million each year post-trial seeking execution of the people currently on death row;"

Even if this is only partially true, why is the system set up like this? Is there ever a reason to spend this much money trying to put someone to death? We didn't always use to spend this much, we just executed people who we found guilty of heinous crimes and life went on. It was a part of life that if you break the law there are consequences. I don't doubt that there were many false convictions. Now a days with DNA, false convictions are down aren't they, by alot right?

So why do we (CA) spend more money today pursuing the death penalty, when we have never been more certain of the conviction?

This is what drives people nuts!

I sort of agree with you. I would be open to a compromise where the death penalty only becomes an option when the evidence is above a certain bar.

Unfortunately that's not how it works. The degree of punishment in our system isn't tied to the degree of evidence. You either "did it" or you didn't.

Most capital punishment cases still have no DNA or other hard proof. In fact, we recently killed a dude in Texas for arson where the jury, the judge, and the district attorney all admitted after the fact that he was probably innocent. There was no DNA or other hard evidence. It was all circumstantial.

That kinda bothers me.

I'd be interested to know the number of people sentenced to life in prison and death each year. Is the system skewed either way? I mean, maybe there's not enough room in prisons to incarcerate all of them. However, people wait 10-20+ years to actually be executed so they must have room somewhere.

I don't feel my vote counts as much on a federal level as it does on a local level, I participate in the things I can effect or want to effect.

Edit: Don't get me started on sex scenes. Horrible exploitation of actors and actresses bodies in order to attract more people to the movies. And it works! >:|

That kinda bothers me too however the justice system was also designed so that jurors were to decide the outcomes of cases. This is a good thing because its better that you're convicted by your peers than by some board or individual appointed by the government (yikes). You can't be implying that a jury shouldn't be afforded the responsibility of deciding what is beyond a reasonable doubt right (however stupid or prejudice they may be)?

I'm not saying that the system is perfect, in fact I admit that it's far from perfect, but it will NEVER BE PERFECT. Regardless of that, the death penalty is still a good idea, it is a deterrent to the people who would commit heinous crimes in the future.

Of course not. I think we're in general agreement. I think having juries decide guilt/innocence is still the best system. There's something nice and democratic about it. But what if we did some sort of compromise? What if the punishment were at least somewhat tied to the quality of evidence?

That is, you kill someone and get convicted. But in one case, it's circumstantial or based on (potentially really shaky) eye-witness testimony. There's nothing physical linking you to the crime. In the other, your DNA is all over the scene. And there's a video of you capping the guy.

It strikes me that we should encourage some sort of rational scale there, between the death penalty and life in prison. The way it is right now, it's mostly up to the luck of the draw, and whether or not you get a jury that happens to be in a hangin' mood.
